Terms of service

The contract between you and TontonPro SASU when you purchase, trial or use TontonTools.

These Terms of Service govern access to and use of the TontonTools website, software products, trials, licenses, subscriptions, downloads, documentation and related services. Please read them carefully before downloading, purchasing, activating or using any TontonTools product.

1. Parties

These Terms are entered into between TontonPro SASU — a French simplified joint-stock company with a sole shareholder, share capital EUR 500, registered with the Versailles Trade and Companies Register under number 994 272 045 R.C.S. Versailles, registered office at 15 Rue des Coquelicots, Maison 15, 78500 Sartrouville, France, commercial name TontonTools — and the customer, user, company, organization or individual who accesses, downloads, purchases, activates or uses TontonTools.

2. Professional and consumer use

TontonTools is designed primarily for professional IT use, including endpoint management, SCCM/MECM administration, Microsoft Intune, Microsoft Entra ID, Microsoft 365, Microsoft Graph and related enterprise administration tasks. TontonTools may also be purchased by individual users, including IT engineers, consultants, administrators or other technical users acting outside an enterprise purchasing process.

If you use TontonTools on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you purchase TontonTools as a consumer, mandatory consumer protection rights that cannot legally be excluded remain applicable.

3. Relationship with Lemon Squeezy

Purchases, subscriptions, payment processing, tax calculation, invoicing, renewal, cancellation and customer billing flows may be handled by Lemon Squeezy LLC as Merchant of Record. Where checkout is completed through Lemon Squeezy, the payment and order process is also governed by Lemon Squeezy’s applicable checkout terms, privacy policy and billing rules.

TontonPro SASU remains the publisher and intellectual property owner of the TontonTools software and provides the software license described in these Terms.

4. Definitions

  • Software — the TontonTools desktop applications, tools, scripts, installers, updates and related components made available by TontonPro SASU.
  • License — the limited right granted to the customer to install and use the Software under these Terms.
  • Subscription — a recurring paid license plan giving access to one or more TontonTools products for the duration of the subscription period.
  • Trial — a free, time-limited evaluation period.
  • Activation — the process of linking a license to a workstation, device, tenant, organization or technical environment, depending on the license type.
  • Workstation — a physical or virtual machine on which the Software is installed, activated or used.
  • Documentation — user guides, technical notes, screenshots, product pages, support articles and any other material made available by TontonPro SASU.
  • Consumer — any natural person acting for purposes that do not fall within the scope of their commercial, industrial, craft, liberal or agricultural activity.
  • Professional Customer — any customer acting for business, professional, administrative, consulting or enterprise IT purposes.

5. Products and license tiers

TontonTools may include subscription-based products and standalone products. The current product catalogue may include, among others:

  • Add User to Collection;
  • Add Device to Collection;
  • Create Device in SCCM;
  • Get Primary Device And Email From User;
  • Get Primary User And Email From Device;
  • Duplicate Device Management;
  • Orphan Device Cleaner;
  • Delete Device Everywhere;
  • Obsolete Device Management;
  • SCCM to Intune App Migrator.

Available tiers, included products, activation limits, support levels and prices are displayed on the website or during checkout. TontonPro SASU may add, remove, rename, replace or improve products over time, provided that such changes do not materially reduce the core functionality of an active paid license during the paid period.

6. License grant

Subject to payment of applicable fees and compliance with these Terms, TontonPro SASU grants the customer a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Software. The license is granted only for the number of users, workstations, activations, tenants, environments, products and time periods covered by the purchased tier, subscription or standalone license. No ownership of the Software is transferred to the customer.

7. Restrictions

The customer must not:

  • copy, resell, rent, lease, sublicense, distribute or make the Software available to third parties, except as expressly authorized;
  • share license keys or activation credentials outside the licensed organization or licensed user scope;
  • bypass, disable, manipulate or circumvent licensing, subscription, activation or technical protection mechanisms;
  • use the Software to provide a competing product or service;
  • reverse engineer, decompile or disassemble the Software except to the extent expressly permitted by mandatory applicable law;
  • remove copyright, trademark, proprietary or legal notices;
  • use the Software for unlawful, harmful, fraudulent or unauthorized purposes;
  • use the Software in a way that compromises the security, integrity or availability of third-party systems;
  • use the Software outside the customer’s own authorized IT environment.

8. Customer responsibilities

The customer is responsible for:

  • ensuring that users are trained and authorized;
  • verifying that the Software is suitable for the customer’s environment before production use;
  • testing operations in a non-production or limited scope where appropriate;
  • reviewing results before executing changes;
  • maintaining backups, rollback plans and recovery procedures;
  • complying with internal IT policies and applicable laws;
  • protecting administrative credentials, secrets, tokens and access rights;
  • ensuring that the use of the Software does not violate Microsoft, third-party or internal licensing terms.

TontonTools may automate powerful administrative operations. The customer remains responsible for all actions performed using the Software in its environment.

9. Destructive or sensitive operations

TontonPro SASU is not responsible for damage caused by incorrect configuration, insufficient testing, lack of backups, unauthorized use, misuse, excessive permissions, inaccurate customer data or failure to review actions before execution.

10. Trial

TontonPro SASU may offer a free trial for certain products or tiers. Unless otherwise stated on the website or during checkout, the trial may include:

  • a 14-day evaluation period;
  • access to selected features for testing;
  • no obligation to purchase;
  • possible limitations, watermarking, activation checks or feature restrictions.

At the end of the trial, access may be limited, suspended or disabled unless a valid license is purchased and activated. TontonPro SASU may modify, suspend or withdraw trial offers at any time.

11. Subscriptions, renewal and cancellation

Subscriptions may be offered monthly or annually. Unless otherwise stated during checkout, subscriptions renew automatically at the end of each billing period until cancelled. Cancellation may be managed through the Lemon Squeezy customer portal or any other cancellation method made available to the customer.

For consumers, where an online subscription is available, TontonPro SASU will provide or make available a clear online cancellation process, either directly or through the customer portal of the Merchant of Record. Cancellation prevents future renewal but does not necessarily trigger an automatic refund for the current billing period unless required by law, stated during checkout or granted under the refund policy below. After cancellation or expiry, access to paid features, updates, support and activation services may be suspended or terminated.

12. Standalone licenses

Some products, such as SCCM to Intune App Migrator, may be sold as standalone licenses. Unless otherwise stated during checkout, a standalone license:

  • is limited to the scope, size or migration volume purchased;
  • is valid for the period stated at purchase;
  • may include updates or support only for the period specified;
  • may not be reused for unrelated projects, customers or environments unless expressly authorized.

13. Prices and taxes

Prices are displayed on the website or during checkout, and may be shown exclusive or inclusive of taxes depending on the customer’s location, status and the Merchant of Record checkout configuration. Where Lemon Squeezy acts as Merchant of Record, applicable VAT, sales tax or equivalent taxes may be calculated, collected and invoiced by Lemon Squeezy.

TontonPro SASU may change prices at any time. Price changes do not affect already paid periods unless otherwise permitted by law or clearly communicated before renewal.

14. Consumer right of withdrawal

If you purchase as a consumer located in the European Union or in another jurisdiction granting a mandatory right of withdrawal for distance contracts, you may have the right to withdraw from the purchase within 14 days, unless an exception applies.

For digital content or digital services supplied immediately after purchase, the consumer may lose the right of withdrawal where the performance has begun before the end of the 14-day withdrawal period with the consumer’s prior express consent and acknowledgement that they thereby lose their right of withdrawal, where permitted by applicable law.

Where the right of withdrawal applies and has not been validly waived, you may exercise it by sending a clear statement to contact@tontontools.com, or through any withdrawal or refund process made available by the Merchant of Record.

If you are a consumer and you have a legal right of withdrawal, you may use the model withdrawal form below. Use of this form is not mandatory. You may also send any other clear written statement expressing your decision to withdraw.

Please note that purchases, payments, invoicing and refunds may be processed by Lemon Squeezy LLC acting as Merchant of Record. Where your order was processed by Lemon Squeezy, the refund may be handled through Lemon Squeezy’s checkout, billing or customer support process.

This section does not limit any mandatory rights granted to consumers by applicable law.

15. Refund policy

Unless a different refund rule is displayed during checkout, the following commercial refund policy applies:

  • First purchase of a subscription — refund requests may be accepted within 30 days of purchase.
  • Annual subscription — after 30 days, a partial refund may be considered if a material defect prevents normal use and TontonPro SASU is unable to provide a reasonable fix or workaround within 14 days after receiving sufficient technical information.
  • Standalone migration license — refund requests may be accepted within 30 days if the license has not been materially used for a completed migration or production migration output.
  • Abuse — repeated purchases and refund requests, license misuse or violation of these Terms may result in refusal of a discretionary refund.

Refunds are processed through the Merchant of Record where applicable. Mandatory statutory rights, where applicable, remain unaffected.

Where the customer is a consumer and mandatory consumer law applies, the customer benefits from the legal guarantees and remedies that cannot be excluded by contract, including any applicable legal guarantee of conformity and guarantee against hidden defects. These mandatory rights apply independently from any commercial warranty or refund policy offered by TontonPro SASU or by the Merchant of Record.

For professional customers, the Software is provided for professional use and the warranty regime is limited to the provisions expressly stated in these Terms, subject to mandatory law.

17. Consumer mediation

If you are a consumer and a dispute with TontonPro SASU cannot be resolved after a written complaint sent to contact@tontontools.com, you may refer the dispute free of charge to the consumer mediator appointed by TontonPro SASU, in accordance with applicable French consumer law. The appointed consumer mediation body is:

  • CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 Rue de Ponthieu, 75008 Paris, France.
  • Website — cm2c.net.

The consumer must first submit a written complaint to TontonPro SASU and allow a reasonable period for a response. If no satisfactory solution is reached, the consumer may submit the matter to CM2C through its online procedure or by following the instructions available on the CM2C website. Consumer mediation is free of charge for the consumer, except for any optional costs the consumer may choose to incur, such as representation, assistance or expert advice. The consumer remains free to accept or refuse the mediator’s proposed solution and may bring the matter before the competent courts if no agreement is reached.

18. Support

Support levels depend on the purchased tier and may be described on the pricing page or during checkout. Support is generally provided by email unless otherwise stated, and may include reasonable assistance with installation, activation, product usage, bug reports and troubleshooting. Support does not include:

  • full consulting services;
  • production administration on behalf of the customer;
  • emergency intervention;
  • Microsoft tenant administration;
  • SCCM, Intune, Entra ID or Microsoft 365 architecture redesign;
  • correction of customer scripts, infrastructure or third-party misconfigurations;
  • recovery from actions performed without adequate backup or validation.

TontonPro SASU may offer separate professional services under a separate agreement.

19. Updates and changes to the Software

TontonPro SASU may provide updates, patches, improvements or new versions. Updates may be required for security, compatibility, licensing, bug fixing or continued access to online services. TontonPro SASU may discontinue obsolete versions, provided that reasonable transition information is made available where appropriate.

20. Beta features

Some features may be labelled as beta, preview, experimental or early access. Such features are provided for testing and evaluation and may be incomplete, unstable, modified or discontinued at any time. Beta features should not be used for critical production operations without appropriate validation and backups.

21. Intellectual property

The Software, website, Documentation, logos, product names, screenshots, design, source code, compiled code, workflows and related materials are owned by TontonPro SASU or its licensors. Except for the limited license expressly granted under these Terms, no intellectual property right is transferred to the customer.

Feedback, suggestions or improvement ideas submitted by the customer may be used by TontonPro SASU without restriction or compensation, provided that no customer confidential information is intentionally disclosed.

22. Confidentiality

Each party may receive non-public information from the other party. The receiving party must use reasonable care to protect confidential information and must not disclose it to third parties except where necessary for performance of the contract, legal compliance or professional advice. The customer must not submit unnecessary confidential, sensitive or regulated data through support channels.

23. Personal data

Personal data is processed in accordance with the TontonTools Privacy Policy. The customer remains responsible for ensuring that any personal data processed in its own IT environment through the use of the Software is processed lawfully. TontonPro SASU does not require access to customer production personal data unless the customer voluntarily provides such data for support or diagnostic purposes.

24. Third-party services

TontonTools may interact with third-party systems, including Microsoft products and services such as SCCM/MECM, Microsoft Intune, Microsoft Entra ID, Microsoft Graph and Microsoft 365. The customer is responsible for having valid rights, licenses, permissions and administrative authorizations to use those third-party services. TontonPro SASU is not responsible for changes, outages, API limitations, permissions, licensing decisions or technical restrictions imposed by third-party providers.

25. Warranty disclaimer

The Software and website are provided with reasonable professional care. However, except as expressly stated in these Terms or required by applicable law, TontonPro SASU does not guarantee that:

  • the Software will be error-free;
  • the Software will meet every customer-specific requirement;
  • the Software will be compatible with every environment, version, tenant configuration, security policy or third-party tool;
  • all results produced by the Software will be complete or accurate without customer validation;
  • access to the website, licensing server or download service will be uninterrupted.

26. Limitation of liability

To the maximum extent permitted by applicable law, TontonPro SASU shall not be liable for indirect damages; loss of profits, revenue, business opportunity, data, production or goodwill; business interruption; consequences of customer misuse; consequences of insufficient backups or testing; third-party service failures; or unauthorized use of administrative credentials.

For paid professional customers, TontonPro SASU’s total aggregate liability for direct damages shall not exceed the amount paid by the customer for the affected product during the 12 months preceding the event giving rise to the claim. For consumers, nothing in these Terms limits or excludes any liability or remedy that cannot be limited or excluded under applicable consumer law.

27. Termination

TontonPro SASU may suspend or terminate access to the Software, license services, support or customer portal access if the customer:

  • fails to pay applicable fees;
  • breaches these Terms;
  • circumvents licensing controls;
  • shares license keys unlawfully;
  • uses the Software unlawfully or dangerously;
  • creates security or fraud risks;
  • infringes intellectual property rights.

Upon termination, the customer must stop using the Software and uninstall it where required. Clauses relating to intellectual property, confidentiality, payment obligations, liability, restrictions, governing law and dispute resolution survive termination.

28. Changes to these Terms

TontonPro SASU may update these Terms from time to time. The latest version will be made available on the website. For active paid subscriptions, material changes that significantly affect the customer’s rights or obligations will apply from the next renewal period, unless immediate application is required by law, security reasons or technical necessity. Continued use of the Software after the effective date of updated Terms constitutes acceptance of the updated Terms.

29. Governing law

These Terms are governed by French law.

30. Jurisdiction

For professional customers, any dispute arising out of or in connection with these Terms, the website, the Software or the related services shall fall within the jurisdiction of the competent courts of Versailles, France, unless mandatory law provides otherwise. For consumers, mandatory consumer jurisdiction rules remain applicable.
